Acceptance of Terms

The following terms and conditions govern all use of the ivenix.com website (the “Site”). The Site is offered subject to acceptance without modification of any of the terms and conditions contained herein or all other operating rules, policies and procedures that may be published from time to time on this Site by Ivenix, Inc. (“Ivenix”) (collectively, the “Terms of Use”).

Ivenix reserves the right, at its sole discretion, to modify or replace any of these Terms of Use at any time. It is your responsibility to check the Terms of Use periodically for changes. Miscellaneous

These Terms of Use shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, excluding its conflicts of law rules, and the United States of America. If any provision of the Terms of Use is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms of Use will otherwise remain in full force and effect and enforceable.

Privacy Policy

Ivenix, Inc. (“Ivenix” or “we” and through similar words such as “us”, “our”, etc.) considers the privacy and security of user information an important component of the services offered at its website, ivenix.com (the “Site”). The following information explains how Ivenix collects and uses information obtained from users in connection with their use of the Site.

EU Personal Data

If you are located in the European Union (“EU”), United Kingdom, Lichtenstein, Norway, or Iceland, you may have additional rights under the EU General Data Protection Regulation (the “GDPR”) with respect to your Personal Data, as outlined in the EU Privacy Notice below.

Information Collected

At your election (“opt-in”), you may request (and Ivenix may provide) additional information about Ivenix or subscribe to various information services (e.g., email lists, newsletters, social media features, etc.) concerning Ivenix’s business (collectively, and together with the Site, the “Services”). When you do so, our registration process requires you to provide certain information about you that can be used to contact or individually identify you, for example, your first and last names, company/organization name, telephone number, email address, profession and certain additional information or comments about your interest in Ivenix (collectively, “Personal Data”).

Use of Personal Data

Ivenix uses Personal Data to respond to your inquiries for additional information, and in providing additional information according to your preferences. Sometimes Personal Data is used to send you information about Ivenix and its products and Services. Ivenix may also use Personal Data to track your activity solely within the Site so that we may, for example, better customize the Site or improve it generally for our users. At your election at any time (“opt-out”), you may choose to stop receiving future communications from Ivenix.

Sharing of Information

Currently, Ivenix will not share Personal Data with any third party for commercial purposes. Security

Information, including Personal Data, collected by Ivenix is stored in secure operating environments that are not made generally available to the public. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, Ivenix cannot ensure the security of any information you provide, and you do so at your own risk. Once Ivenix receives your transmission, it will make reasonable efforts to ensure its security on its systems.

Third Party Sites

The Site may permit you to link to other websites on the Internet, and other websites may contain links to the Site. These other websites are not under Ivenix’s control. The privacy and security practices of websites linked to or from the Site are not covered by this Privacy Statement, and Ivenix is not responsible for the privacy or security practices or the content of such websites.

IP Addresses and Cookies

Ivenix uses your IP address to help diagnose problems with its server, to administer its Services, and to analyze traffic patterns on the Site or Services. The Services also use cookies and similar technologies such as pixel tags, web beacons, clear GIFs, and JavaScript (collectively, “Cookies”) to enable Ivenix’s servers to recognize your web browser and tell Ivenixhow and when you visit and use the Site and Services, to analyze trends, learn about our user base and operate and improve our Services. Cookies are small files – usually consisting of letters and numbers – placed on your computer, tablet, phone, or similar device when you use that device to visit the Site. The length of time a persistent Cookie stays on your device varies from Cookie to Cookie. Ivenix uses persistent Cookies to store your preferences so that they are available for the next visit, and to keep a more accurate account of how often you visit the Site or Services, how often you return, how your use of the Services may vary over time. The Site content and services are intended for adult users over the age of 18. The Site is not designed to attract child users. Ivenix is committed to protecting the privacy of children, and does not collect personally identifiable information from any person it actually knows is a child under the age of 13 or in some cases under the age of 16.

Ivenix reserves the right to change or update this Privacy Statement at any time by posting a notice at the Site. Information collected through the Site is subject to the Privacy Statement in effect at the time of use.

How Long Do We Retain Your Personal Data? We retain Personal Data about you for as long as you have an open account with us or as otherwise necessary to provide you Services. Personal Data of Children: We do not knowingly collect or solicit Personal Data from anyone under the age of 16. If you are under 16, please do not attempt to register for the Services or send any Personal Data about yourself to us. If we learn that we have collected Personal Data from a child under age 16, we will delete that information as quickly as possible. What Rights Do You Have Regarding Your Personal Data? You have certain rights with respect to your Personal Data, including those set forth below. For more information about these rights, or to submit a request, please email info@ivenix.com. Please note that in some circumstances, we may not be able to fully comply with your request, such as if it is frivolous or extremely impractical, if it jeopardizes the rights of others, or if it is not required by law, but in those circumstances, we will still respond to notify you of such a decision. In some cases, we may also need to you to provide us with additional information, which may include Personal Data, if necessary to verify your identity and the nature of your request.

  • Access: You can request more information about the Personal Data we hold about you and request a copy of such Personal Data by email info@ivenix.com.
  • Rectification: If you believe that any Personal Data we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data. You can correct some of this information directly by email at info@ivenix.com
  • Erasure: You can request that we erase some or all of your Personal Data from our systems.
  • Withdrawal of Consent: If we are processing your Personal Data based on your consent (as indicated at the time of collection of such data), you have the right to withdraw your consent at any time. Please note, however, that if you exercise this right, you may have to then provide express consent on a case-by-case basis for the use or disclosure of certain of your Personal Data, if such use or disclosure is necessary to enable you to utilize some or all of our Services.
  • Portability: You can ask for a copy of your Personal Data in a machine-readable format. You can also request that we transmit the data to another controller where technically feasible.
  • Objection: You can contact us to let us know that you object to the further use or disclosure of your Personal Data for certain purposes, such as for direct marketing purposes.
  • Restriction of Processing: You can ask us to restrict further processing of your Personal Data.

  • Transfers of Personal Data: The Services are hosted and operated in the United States (“U.S.”) through Company and its service providers, and if you do not reside in the U.S., laws in the U.S. may differ from the laws where you reside.
